§ 1 SCOPE
(1) These Terms and Conditions (hereinafter "Terms") apply to all contracts concluded between

(hereinafter "we" or "Naúma") and the customer (hereinafter "you" or "customer") via the online shop at nauma.shop.
(2) The version of these Terms valid at the time of the conclusion of the contract shall apply.
(3) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
§ 2 CONCLUSION OF CONTRACT
(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the "Buy" / "Place order" button, you submit a binding order for the goods contained in the shopping cart.
(3) Confirmation of receipt of the order is sent immediately after submitting the order by automated email (order confirmation). This order confirmation does not yet constitute acceptance of your offer.
(4) The purchase contract is concluded when we accept your order by sending a shipping confirmation by email or by shipping the goods to you.
(5) We store the contract text and send you the order data by email. You can view the Terms and Conditions on our website at any time.
§ 3 PRICES AND PAYMENT
(1) All prices are final prices in euros and include the applicable value added tax (VAT).
(2) Shipping costs are not included in the purchase price and are shown separately. They will be displayed to you before completing the order.
(3) Payment is made via the payment methods offered in the shop. The available payment methods will be displayed during the checkout process.
(4) For deliveries to countries outside the European Union, additional customs duties, taxes and fees may apply, which are to be borne by the recipient.
§ 4 DELIVERY AND SHIPPING
(1) Delivery is made to the delivery address you provide.
(2) The specified delivery times are non-binding estimates. The delivery period begins after receipt of payment.
(3) Our shipping conditions:
- Germany: Shipping costs €4.99, delivery time approx. 2-3 business days
- EU & International: Shipping costs €11.99, delivery time approx. 2-6 business days
(4) Business days are Monday to Friday, excluding public holidays.
(5) We ship with DHL. Once your order has been shipped, you will receive a shipping confirmation with a tracking number by email.
(6) If delivery of the goods fails due to your fault despite three delivery attempts, we may withdraw from the contract.
§ 5 RETENTION OF TITLE
The delivered goods remain our property until full payment has been made.
§ 6 RIGHT OF WITHDRAWAL
Consumers have a statutory right of withdrawal. Details can be found in the cancellation policy, which is part of these Terms and can be viewed on our website.
§ 7 WARRANTY
(1) The statutory warranty rights apply.
(2) Please inspect the goods upon receipt for transport damage and report any obvious defects immediately to facilitate the assertion of your claims. However, this does not affect your statutory warranty rights.
(3) The warranty period for new goods is two years from receipt of the goods.
§ 8 LIABILITY
(1) We are fully liable for intent and gross negligence as well as for damages resulting from injury to life, body or health.
(2) In cases of slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations). In these cases, liability is limited to the foreseeable, typical damage.
(3) The above limitations of liability do not apply to claims under the German Product Liability Act or in cases of fraudulent concealment of a defect or assumption of a guarantee.
§ 9 COPYRIGHT
All contents of the online shop (texts, images, graphics, logos) are protected by copyright. Use without our express consent is not permitted.
§ 10 DATA PROTECTION
Information on the processing of your personal data can be found in our Privacy Policy on our website.
§ 11 DISPUTE RESOLUTION
(1) The EU Commission provides a platform for online dispute resolution (ODR), which you can find at the following link: https://ec.europa.eu/consumers/odr
(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 FINAL PROVISIONS
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with habitual residence in another EU member state, mandatory provisions of the local consumer law remain unaffected.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships is Cologne, Germany.
(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
